Neutral Citation No. - 2025:AHC-LKO:19165 Court No. - 18 Case :- WRIT - A No. - 3562 of 2025 Petitioner :- Arun Kumar Respondent :- State Of U.P. Thru. Principal Secretary , Home , Civil Secretariat , Lucknow And Another Counsel for Petitioner :- Zubair Hasan Counsel for Respondent :- C.S.C. Hon'ble Karunesh Singh Pawar,J. Heard learned counsel for the petitioner and learned Standing counsel for the respondents. The petition has been filed with the following main prayer:- "the petitioner most respectfully prays for issuance of a writ, direction or order in the nature of Mandamus commanding the opposite party no.01 and 02 to permit the petitioner to participate in process of selection of the post of Constable in the U.P. Police as petitioner has been short listed and selected in the above process". Learned counsel for the petitioner submits that the petitioner has qualified the written examination for the post of Constable in the State of Uttar Pradesh. However, he apprehends that his candidature may be cancelled at a later stage during character verification, as a criminal case is pending against him. It is, however, fairly conceded by him that no adverse order has been passed against him as of now. It is further submitted that the present writ petition has been filed merely on the basis of apprehension, as earlier also, his candidature was rejected due to the pendency of a criminal case. Learned Standing Counsel has opposed the petition, contending that a writ petition filed merely on apprehension is not maintainable. Having perused the record and upon consideration of the submissions advanced, it is evident that the present writ petition has been filed solely on the basis of apprehension, without there being any adverse order passed against the petitioner at this stage. Accordingly, the writ petition is held to be premature and not maintainable. The writ petition is, accordingly, dismissed. However, liberty is granted to the petitioner to approach this Court again, if any adverse order is passed against him at the appropriate stage. Order Date :- 5.4.2025 R.C.
