Karmakar, Advocate. For the State : Mr. Arup Kr. Dey, A.P.P. ----- 05/ 10.07.2025 Heard the parties. 2. This anticipatory bail application under Sections 482 and 484 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioner apprehending his arrest for offences registered under Sections 47(a) of the Excise Act. 3. Learned A.P.P. representing the State opposes the prayer for anticipatory bail. 4. Though in the complaint it has been reported that 244.74 litres of foreign liquor was recovered from the premises but as per the prosecution report the recovery is of 199.200 litres. Further it has been mentioned that the material was recovered from Kanchan Nagar but there is nothing to suggest that the petitioner is the owner of the said premises. 5. Further cognizance has been already been taken in this case. 6. Considering the aforesaid fact that this case arises of complaint and cognizance has already been taken, this Court finds it a fit case for grant of anticipatory bail to the petitioner. 7. Accordingly, this Anticipatory Bail Application stands allowed. The petitioner, above named, is directed to surrender before the learned court below within four weeks from the date of receipt of copy of this order and on the event of his surrender or arrest, he shall be released on bail on furnishing 2025:JHHC:18715 2 bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, 1st Class, Jamshedpur, in connection with Complaint Case No.1378 of 2023, subject to the condition that one of the bailers should be a close relative of the petitioner and other should be a resident of State of Jharkhand, having sufficient landed property in his/her name or in the name of his/her ancestors in which he/she is having share and to that effect, he/she has to file an affidavit before the Trial Court indicating his/her share in the property. 8. 8. Further the petitioner is directed to appear before the trial court and file his undertaking that he will appear on each and every date during trial and will cooperate in disposal of the case as early as possible.
