2. Mr. Sudhir Kumar Nailwal, learned Standing Counsel for the State of Uttarakhand.
3. Petitioner possesses Basic Training Certificate (B.T.C.) besides bachelor’s degree, which makes him eligible for appointment as Assistant Teacher in a government basic school.
4. Petitioner has challenged Rule 15 (3) of the Recruitment Rules, applicable for the post of basic school teachers, which treats B.Ed qualification holders as eligible for appointment as teacher in a government basic school.
5. Since the Hon’ble Supreme Court in the case of “Devesh Sharma vs. Union of India and Others”, reported in 2023 11 S.C.R. 167, has held that B.Ed is not a sufficient qualification for appointment as teacher in a basic/primary school, therefore, the
2025:UHC:2111-DB candidates with B.Ed qualification cannot be appointed as Assistant Teacher in government basic school.
6. With the aforesaid observations, Writ Petition (S/B) No. 39 of 2021 stands
disposed of accordingly.
