Neutral Citation No. - 2025:AHC-LKO:18786 Court No. - 6 Case :- WRIT - C No. - 3115 of 2025 Petitioner :- Avashesh Kumar Singh Respondent :- State Of U.P. Thru. Prin. Secy. U.P. Deptt. Of Food And Civil Supplies Lko. And 6 Others Counsel for Petitioner :- Bhagwati Prasad Nigam,Anurag Shukla Counsel for Respondent :- C.S.C.,Dilip Kumar Pandey Hon'ble Pankaj Bhatia,J. 1. Heard learned counsel for the petitioner. 2. The present petition has been filed challenging the passing of the resolution in favour of respondent No.7. 3. The contention of learned counsel for the petitioner is that respondent No.7 was not a resident of the village and thus was not entitled to participate in the proceedings for selection. He relies upon the earlier report to argue that respondent No.7 was not a resident of the village. The fact remains that the resolution passed in favour of respondent No.7 is subject to approval by the Tehsil Level Committee, which according to the petitioner, has not been done so far. 4. Considering the fact that the Tehsil Level Committee has to pass the resolution, the petition is disposed of permitting the petitioner to file objection before the Tehsil Level Committee, which shall also be taken into consideration prior to passing the order of approval, in accordance with law. 5. Respondent No.7 shall also be heard in support of his contention prior to passing of the order.
