PUBLIC PROSECUTOR The Court made the following|| ORDER:- Th'ls Criminal Petition, under Sections 480 and 483 of the BNSS, has been filed by the petitioners/Al and A2, seeking regular bail, in Crime No.26 of 2025 of Kothakota Police Station, Anakapalli District . 2. A case has been registered against the Petitioners/Al and A2 for the offences punishable under Sections 20(b)(ii)(B) r/w

I JJ 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short tthe NDPS Act'). 3.
The brief facts of the case are that on 18.03.2025 at 18.00 hours on credible information about the transporation of contraband of ganja, the Sl of Police along with staff and mediators reached at Dondapudi Check Post and noticed two male persons were coming on the road by carrying luggage bags and the police apprehended the two persons and opened the luggage and found 10 kgs of ganja. Then the Sl of Police arrested the accused Nos.1 and 2 and sent them to judicial remand and seized the ganja. Thereupon, the Sl of Police registered the same as a case in Crime' No.26 of 2025 and investigated into. 4. Heard. Perused the record. 5. The learned counsel for the petitioner submits that the petitioners have been in judicial custody since 18.03.2025. The learned Assistant Public Prosecutor has opposed granting bail to the petitioners on the ground that the investigation was not completed. The learned counsel further submits that the contraband involved in this case is 10 kgs. The petitioners `-\ fry
belong to Telangana State. When ascertained the learned Assistant Public Prosecutor confirmed that the petitioners have no antecedents. As the contraband seized is not of commercial quantity, no reasons need to be recorded as contemplated under Section 37 of the NDPS Act. Most of the Witnesses are shown to be official witnesses` and the release of the accused would not cause hampering of investigation. As most of the investigation might have been completed, as such, this Court is inclined to grant bail to the petitioners/Al and A2 with the following conditions. (i) The petitioners/Al and A2 shall be released On executing a personal bond for Rs.25,000/- (Rupees twenty five thousand only) each with two sureties for a like sum each tO the satisfaction of the learned I-Additional District & Sessions Judge- cum-special Judge for Trial of Offences under NDPS Act, Visakhapatnam.
(ii) After release, the petitioners shall appear before the station House Officer concerned, once in a fortnight for a Period of three (03) months. EE Eio
