Neutral Citation No. - 2025:AHC:21638-DB Court No. - 39 Case :- WRIT - C No. - 2804 of 2025 Petitioner :- Smt Fullo Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Kuldip Singh Yadav Counsel for Respondent :- Anadi Krishna Narayana,C.S.C. Hon'ble Siddhartha Varma,J. Hon'ble Dr. Yogendra Kumar Srivastava,J.
1. Case called out in the revised list. No one appeared on behalf of the petitioner to press the petition. However, learned counsel, Sri Sandeep Kumar Singh, is present for the respondent-bank.
2. Learned counsel appearing for the bank has drawn the attention of the Court to the order passed on 07.02.2024 in a writ petition earlier preferred by the petitioner being Writ - C No. - 1543 of 2024 [Smt. Fullo Vs. State of U.P. and 3 Others].
3. Looking into the order dated 07.02.2024, passed in the aforesaid writ petition, we find that the while entertaining that petition this Court had granted its indulgence and had provided that the petitioner could pay the amount in installments, which was due to the bank. It appears and as indicated by the counsel for the respondent-bank, the petitioner has not abided either by her undertaking to pay the due amount in installments or by the order of the High Court, dated 07.02.2024, and hence an auction notice was issued on 22.11.2024, which the petitioner challenges in the present writ petition.
4. In such view of the matter and taking into account the fact that the petitioner did not abide by the order of the High Court dated 07.02.2024 passed in Writ - C No. - 1543 of 2024, no interference
is warranted by this Court by acceding to the prayer of the petitioner in the present petition.
5. The writ petition is therefore dismissed. Order Date :- 14.2.2025 Arun K. Singh [Dr. Y.K. Srivastava, J.] [Siddhartha Varma, J.] Digitally signed by :- ARUN KUMAR SINGH High Court of Judicature at Allahabad
