The present petition has been filed basically prayer that an application has been filed under Section 23 of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, which is pending. 3. The Counsel for the petitioner appearing on behalf of the respondents says that the said application is not maintainable under the Act. 4. Considering the fact that the application is pending before the SDM, Tehsil Kaisarganj, District Bahraich, the SDM is directed to pass order on the said application after hearing the parties in accordance with law. 5. It is made clear that this Court has not expressed any opinion on the merits of the case. 6. In case any application in accordance with law has been filed, the same shall be considered and decided expeditiously in accordance with law. 7. The writ petition is disposed off in the above terms.
