WP(C) 909/2024 CM(2447/2024) MOHAMMAD ASHRAF DAR …Petitioner/Appellant(s) Through: Mr. Sikander Hayat Khan, Advocate Vs.
THE JAMMU & KASHMIR BANK LTD & ANR. ...Respondent(s) Through: Ms. Taniya, Advocate CORAM:
HON’BLE MR. JUSTICE SANJEEV KUMAR, JUDGE HON’BLE MR. JUSTICE SANJAY PARIHAR, JUDGE ORDE R 12.11.2025
1. The order dated 1st May, 2024, has not been complied with even after a lapse of more than a year. It is fairly stated by the learned appearing counsel for the petitioner that an order passed by the Chief Judicial Magistrate [<CJM=] in terms of Section 14 of the SARFAESI Act is subject matter of challenge in a separate writ petition, i.e., WP (C) No. 755/2025.
2. In view of the non-compliance of the order dated 01.05.2024 and filing of the subsequent petition challenging the order passed by the CJM under Section 14, this petition does not survive and is dismissed as having been rendered infructuous.
3. Interim direction, if any, shall stand vacated.
