The Court made the following ORDER: Heard Sri N.Sai Akash, learned counsel for the petitioner, Sri Ajay, learned Assistant Government Pleader for Home for 3rd respondent and Sri G.Venkateswarlu, learned counsel for respondents 1 and 2. 2. The above writ petition is filed to declare the action of the 2nd respondent in not renewing/reissuing the passport bearing No.L7316264, in pursuance of the application made by the petitioner, vide VJ2077476914125 dated 11.03.2025 due to the pendency of a criminal case, as illegal and arbitrary. 2 3. Learned counsel for the petitioner would submit that the petitioner made an application for renewal / reissuance of passport bearing No.L7316264 vide file No.VJ2077476914125 dated 11.03.2025. 4. Along with the writ petition Ex.P.5- charge sheet in C.C.No.399 of 2022 on the file of the II Additional Junior Civil Judge, Sattenapalli is also filed. The petitioner herein is shown as Accused No.5 in the above criminal case. 5. Learned Assistant Government Pleader for Home would submit that the learned Magistrate has taken cognizance, and the C.C.No.399 of 2022 is coming up for trial. Learned AGP would submit that since cognizance has been taken by the learned Magistrate, the petitioner has to approach the jurisdictional court. 6. In reply, learned counsel for the petitioner would submit that the petitioner will approach the jurisdictional Magistrate. 7. Given the facts and circumstances of the case, without going into other aspects, since C.C.No. 399 of 2022 is pending against the petitioner, the writ petition is disposed of at the admission stage, with the consent of learned counsel on either side, giving liberty to the petitioner to approach the jurisdictional court i.e. II Additional Junior Civil Judge, Sattenapalli and make an application regarding renewal/reissuance of passport. Upon filing such an application, the learned Magistrate shall consider the same and pass appropriate orders regarding renewal/issuing passport to the petitioner as expeditiously as possible, strictly as per the provisions of the Passports Act and the Rules made thereunder. No order as to costs.
