The application of the petitioner claims that his ailment i.e. Intra Vascular Lithotripsy is covered under the Central Government Health Scheme and the petitioner being a pensioner of the Central Government is entitled to the benefit of the same. Accordingly, he has submitted the documents through the C.G.H.S. Office at Lucknow i.e. opposite party no. 3 online on 11.11.2024 , and the opposite party no. 3 transmitted the same to opposite party no. 2 for consideration where it is lying till date. On account of the opposite party no. 2 not taking any decision on the application, the treatment of the petitioner is being delayed. In view of the above, we direct the opposite party no. 2 to take a considered decision on the application of the petitioner, a copy of which is annexed as Annexure No's. 5 & 6 to the writ petition, at the earliest say within a period of three weeks, unless the decision has already been taken, in which case, it shall be communicated to the opposite party no. 3 and the petitioner within the aforesaid period. Shri Varun Pandey, learned Counsel for the opposite party no. 2 shall communicate this order to the said Officer for compliance. The writ petition is accordingly disposed of.
