The petitioner seeks grant of housing patta in respect of Gata No.1002M/16 dhur (new gata no.941) and Gata No. 1005M/2 dhur, which is situated in village Kaudahi, pargana Bidhar, tehsil Alapur, District Ambedkar Nagar on the ground that the lease of the said land was granted in favour of his father late Mohd. Israil on 12.07.1979 and the father of the petitioner had constructed a house on the said land, on which the petitioner is residing. He states that he has other brothers and sisters also. 3. Learned Counsel for Gaon Sabha states that private opposite party nos.6 to 9 claim right and title in respect of the land and house being claimed by the petitioner as his. Further, the petitioner has already filed civil suit seeking injunction against them. 4. This is not a matter of jurisdiction under Article 226 of the Constitution of India. 5. The writ petition is disposed of with liberty to the petitioner to pursue the matter with the authorities or before the Court concerned, as the case may be. (Om Prakash Shukla, J.) (Rajan Roy, J.)
