PUBLIC PROSECUTOR The Court made the following: The Criminal Petition, under Section 482 of the BNSS, is filed on behalf of the petitioner herein/A1 to grant anticipatory bail in connection with Crime No.22 of 2025 of Rajahmundry I Town Police Station, East Godavari District. The above said crime was registered against the petitioner and another for the offence punishable under Sections 7-B read with 8(B) APPA. Case of the prosecution, in brief is that on 02.02.2025, the Sub-Inspector of Police along with his staff rushed to Somalamma Temple, Kothapeta, Rajamahendravaram, and caught A2 in possession of 10 liters of I.D. Liquor. The said I.D. Liquor was seized under the cover of occurrence report. 2. 3. 2 Heard. Perused the record. 4. Learned counsel for the petitioner submits that basing on 5. the confessional statement of A2, the petitioner herein is arrayed as accused in the present crime. Except the said confessional statement, no other incriminating material has been collected showing the complicity of the petitioner in the commission of offence. On the other hand, learned Assistant Public Prosecutor 6. vehemently opposed the grant of bail to the petitioner herein and further submits that the petitioner has no previous criminal antecedents. It is submitted by the learned counsel for the petitioner that the petitioner herein had permanent abode and there is no possibility of his fleeing away from the justice and the release of the petitioner would not cause hampering of investigation 7. In view of the aforesaid facts and circumstances of the case and since the petitioner herein is arrayed as accused based on the confessional statement of A2, this Court is inclined to grant anticipatory bail to the petitioner herein/A1, on the following conditions: (i) The petitioner/A1 is directed to surrender before the Station House Officer concerned, within a period of two 3 * weeks from today. On such surrender, the petitioner/A1 is ordered to be enlarged on bail on his executing a personal bond for Rs.5,000/- (Rupees five thousand only) with one surety for the like sum each to the satisfaction of the Station House Officer concerned. (ii) The petitioner shall make himself available for investigation as and when required and that he shall not cause any threat, inducement or promise to the prosecution witnesses.
