Present petition has been filed with the following prayer: "i) Issue a writ, order or direction in the nature of Mandamus commanding/directing the opposite parties Nos.3 & 4 to ensure the eviction of opposite parties Nos.7 to 10 from the Gaon Sabha land Gata No.26 Ka, situated at Village Mathiya, Gaon Sabha Kishungarh, Pargana Atheha, Tehsil Lalganj, District Pratapgarh." 2. Learned Standing Counsel, based upon instructions, states that offending encroachments have already been removed. 3. The said fact is disputed by learned counsel for the petitioner. 4. Considering the fact that the orders have already been passed, the petitioner would be at liberty to file an application under Clause 460 of U.P. Revenue Code Mannual for execution of the orders. 5. In case such an application is filed, the same shall be decided expeditiously and in accordance with law. 6. Present petition stands disposed off in above terms.
