At the very outset, Shri Shivam Sharma, counsel for the opposite party nos.2 and 3 has stated that on account of Government Order dated 30.07.2007 (Annexure No.8 to this petition), the petitioner may not be paid gratuity inasmuch as the petitioner retired before issuance of aforesaid government order and the Government Order dated 30.07.2007 has been made effective with immediate effect, therefore, as per Shri Shivam Sharma, pending representation of the petitioner may not be decided in terms of request made in that representation. 3. Learned counsel for the petitioner has requested that he may be permitted to not press this petition at this stage and liberty may be given to file fresh petition. 4. Considering the aforesaid request, this petition is dismissed being not pressed with the aforesaid liberty.
