Applicant Ram Bilas Yadav is in judicial custody in ECIR No. ECIR/DNSZO/04/022 dated 24.08.2022 under Section 3/4 of the Prevention of Money Laundering Act, 2002, at Directorate of Enforcement, Dehradun. He has sought his release on bail.

Heard learned counsel for the parties and perused the record.

Learned counsel appearing for the applicant would submit that the applicant is struggling in his life; he is seriously ill; he is a known case of Metastatic GIST jejunum with renal cell carcinoma; operation cannot work, therefore, he is going continuous chemotherapy. Learned counsel would submit that the applicant is critical; he is 63 years of age. The medical certificate from Sir Ganga Ram Hospital, New Delhi has been produced, which gives the following certificate:-

“Medical Certificate This is to certify that Mr. Ram Bilas Yadav, Registration Number:3304569 is a known case of metastatic GIST jejunum with renal cell carcinoma. He has been operated in Jan 2024 and biopsy showed cancer at two places with metastatic deposits of GIST in the other parts of abdomen. He was treated with adjuvant chemotherapy and had long side effect of chemotherapy. He is still under treatment and requires close follow up.”

Learned counsel for the Directorate of Enforcement would submit that, as per the instructions, after surgery the tumour has spread in the stomach of the applicant and his condition is not good. Learned counsel also verifies the medical certificate issued from Sir Ganga Ram Hospital, New Delhi.

Having considered the age of the applicant, time of the disease, the treatment, which the applicant is going on, this Court is of the view that without adverting to the merits of case, purely on humanitarian ground, the applicant is entitled to be enlarged on bail.

The bail application is allowed.

Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the court concerned.
