Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor appearing for the State. 2. The learned counsel for the petitioner submits that the petitioner was arraigned as accused in Crime No.61 of 2025 of Bheemunipatnam Police Station, Visakhapatnam District, registered for the alleged offences under Sections 85 of the Bharatiya Nyaya Sanhita, 2023 and Sections 3 and 4 of the Dowry Prohibition Act, 1961. 3. The learned counsel further submits that the petitioner is the husband of the 2nd respondent. On account of marital disputes, the 2nd respondent falsely implicated the petitioner. The learned counsel seeks a direction to the police to follow the procedure provided under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023. 4. Considering the submissions of the learned counsel for the petitioner, the Station House Officer, Bheemunipatnam Police Station, Visakhapatnam District, is directed to follow the procedure as contemplated under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023 insofar as the petitioner is concerned, for the purpose of investigation in connection with Crime No.61 of 2025. -3- W.P. No.3621 of 2025 5. Accordingly, the criminal petition is disposed off. 6. Miscellaneous petitions, if any, pending in the criminal petition shall stand closed. ____________________ JUSTICE HARINATH.
