1. Heard Mr. S Nawaz, learned counsel for the petitioner. Also heard Mr. P Borthakur, learned Additional Public Prosecutor for the State of Assam. 2. It is noticed that the petitioner was enlarged on interim bail on
Page No.# 2/3 27.05.2025 by this Court and a report was called for from the Officer-in-Charge of Dharamtul Police Station in view of the fact that till then, no F.I.R was registered against the petitioner. 3. When the matter again was posted on 01.08.2025, Mr. P Borthakur, learned Additional Public Prosecutor for the State of Assam submitted a report and from the report it appeared that the enquiry, in respect of the GD Entry was going on and that till the said date, no case was registered against the petitioner. As such, by extending the interim order, this Court called for a detailed report from the concerned Police Station. 4. When the matter is called up today, Mr. P Borthakur, learned Additional Public Prosecutor for the State of Assam has placed a detailed report from the Officer-in-Charge of Dharamtul Police Station wherein it is reflected that a complaint was lodged by one Sri. Mantu Medhi against the petitioner who was alleged to have used obscene and slang language against the complainant in a public place and that there was a suspicion that the petitioner was also involved in an earlier assault incident on 02.05.2025 and an enquiry was conducted. 5. During the said enquiry, it is further stated that no cognizable offence was found for registration of any F.I.R and as such, a non- FIR has been submitted against both the informant and the petitioner before the Hon’ble C.J.M, Morigaon vide Dharamtul P.S Non-FIR Part-I No. 31/2025 under Section 126 of BNS, 2023 dated
05.08.2025. 6.
In view of the said report, this Court deems it fit that the present
