Applicant is in judicial custody in FIR No.0465 of 2024 (In Bail Application No.1626 of 2024), under Sections 309(4), 317(2), 61 read with Section 3(5) of Bharatiya Nyaya Sanhita, 2023, Police Station Kunda, District Udham Singh Nagar. He has sought his release on bail.

Heard learned counsel for the parties and perused the record.

According to the FIR, on 14.09.2024, three miscreants having masked their faces looted the bag of the informant.

Learned counsel for the applicant would submit that the applicant was arrested by the Jaspur Police and the recovery of alleged articles was shown from
2 him. In that case, the applicant has already been granted bail.

Learned State Counsel admits this fact.

Having considered, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail.

The bail application is allowed.

Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the court concerned.
