This criminal miscellaneous petition has been filed under section 528 of BNSS, 2023 by the petitioner with a prayer for modification of the order dated 03.01.2024 passed in CrMP No. 2495 of 2023 inserting the details of the case being OCR Case no. 31 of 2009 corresponding to T.R. no. 648 of 2012. Perusal of the record reveals that vide order dated 03.01.2024, CrMP No. 2495 of 2023 was dismissed as withdrawn with liberty to raise all the grounds taken in this criminal miscellaneous petition before the appropriate court or authority at the appropriate stage. It is submitted by the learned counsel for the petitioner that the trial court is not relying upon the aforesaid order as no details of the pending case has been given in the same. It is pertinent to mention here that when the case is withdrawn, there is no justification to briefly state the facts of the case, and if at all, the petitioner intends to put forth the grounds taken in the criminal miscellaneous petition, it can do so by filing a certified copy of the criminal miscellaneous petition before an appropriate court, hence, this court is of the considered view that there is no justification in modification of the order dated 03.01.2024 passed in CrMP No. 2495 of 2023.
