BEFORE HONOURABLE MR. JUSTICE DEVASHIS BARUAH ORDER Date : 30.05.2025 This is an application filed under Article 227 of the Constitution challenging the order dated 18.01.2025 passed in Misc. J. Case Page No.# 2/2 No.123/2024 arising out of Title Suit No.39/2021. 2. The learned counsel appearing on behalf of the petitioners submitted that taking into account the judgment of the Supreme Court in the case of Ashok Kumar Karla Vs. Wing CDR. Surendra Agnihotri and Others reported in (2020) 2 SCC 394, he would not like to press the instant petition. He however submitted that withdrawal of the instant petition should not affect the petitioners to file a separate suit. 3. Taking into account the above, the instant proceedings stands closed on withdrawal. 4. It is observed that withdrawal of the instant proceedings shall not affect the petitioners to file a separate suit, if so permissible under law. JUDGE Comparing Assistant
