BAI No.2233 of 2024 Hon’ble Alok Mahra, J.
Mr. Shashi Kant Shandilya, learned counsel for the applicant.
2. Mr. Akshay Latwal, Brief Holder for the State.
3. Applicant- Mukesh Pal, who is in judicial custody in connection with FIR No. 265 of 2024, under Section 80(2) of the Bhartiya Nyaya Sanhita, 2023, registered at Police Station Sahaspur, District Dehradun, has sought his release on bail.
4. Heard learned counsel for the parties and perused the material available on record.
5. Learned counsel for the applicant contends that the applicant has falsely been implicated in the case and is languishing in jail since 08.09.2024; the applicant is father-in-law of the deceased; he has never demanded dowry; the daughter of the complainant has always been treated with full respect and has never been treated with any physical or mental cruelty; the applicant has been made an accused on the basis of surmises and conjectures; there is no independent witness of the incident and the deceased committed suicide because she was not happy with the marriage and her marriage was solemnized against her wishes.
6. Per contra, learned Deputy Advocate General vehemently opposed the bail.
7. Considering the submission of learned counsel for the parties and without expressing any opinion as to the final merits of the case, this Court is of the view that application deserves bail on the ground of parity.
8. Accordingly the bail application is allowed.
9. Let the applicant be released on bail, on his executing personal bond and furnishing two reliable sureties, each of like amount, to the satisfaction of Court concerned.
