Heard Shri Dinesh Chandra, learned counsel for the petitioner and learned Additional Chief Standing Counsel for the State. 2. The petitioner claims hindrance and interference by opposite party no. 5 in his fisheries rights which has been settled in his favour in respect to Gata No. 1800 situated at Village Puwansi, Pargana Bihar, Tehsil Kunda, District Pratapgarh. 3. However, Shri Raj Baksh Singh, learned Additional Chief Standing Counsel has written instructions to the effect that pond existing on Gata No. 1812 was settled in favour of opposite party no. 5 but in connivance with certain revenue officials of another area the petitioner has got a confirmation of his alleged bid in respect of the Gata No. 1812 also. An inquiry was conducted wherein the aforesaid illegalities were found. The concerned revenue officials have been suspended. The S.D.M. is in the process of cancelling the alleged allotment of Gata No. 1812 in favour of the petitioner. As regards the Gata no. 1800 he says that petitioner has fishery rights in respect of the same which are not being interfered. 4. In view of the aforesaid, we see no reason to proceed any further in the matter. In the process of cancellation, if it is resorted, the petitioner would obviously be given opportunity of hearing. 5.
