By means of this petition, a prayer has been made to direct the District Magistrate, Lucknow to execute the recovery certificate dated 23.09.2024 issued by the Secretary, U.P. Real Estate Regulatory Authority for recovery of the amount of Rs.25,63,249/- from respondent no. 4. 3. In para 13 & 14 of the writ petition, it has categorically been stated by the petitioner that an appeal bearing no. 50 of 2022 had been filed against the order dated 18.11.2021 passed by the U.P. Real Estate Regulatory Authority, and thereafter, the UP Real Estate Appellate Tribunal passed the order dated 01.04.2024, pursuant to which the recovery certificate dated 23.09.2024 was issued. 4. In view of the aforesaid, this petition is disposed of finally with direction to the District Magistrate, Lucknow to execute the recovery certificate dated 23.09.2024 within a period of three months from the date a certified copy of this order is furnished before him, unless there is any legal impediment in this regard in which case he shall inform the petitioner in writing within the aforesaid period.
