Mahmud, learned counsel for the petitioner. Also heard Mr. K. K. Parasar, learned Additional Public Prosecutor for the State of Assam. 2. This application has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, in respect of Special NDPS Case No.82/2021, pending in the Page No.# 2/3 Court of the learned Special Judge, Sribhumi. 3. The Charge-Sheet was filed against 3(three) accused persons, namely, Sabbir Ahmed, Islam Uddin and the present petitioner Rehan Uddin. Probably the Trial Court did not notice that the name of Rehan Uddin was also shown in the Charge- Sheet, for that matter, the trial continued against Sabbir Ahmed and Islam Uddin. Some witnesses are also examined. 4. Later on, it came to the notice of the Trial Court that the Charge-Sheet was filed against the petitioner Rehan Uddin also. Therefore, the Trial Court directed issue of summons to the petitioner. 5. Now the petitioner apprehends that if he appear before the Trial Court, he will be remanded to custody, because he was shown as an absconder in the Charge- sheet. 6. The learned counsel for the petitioner submits that the petitioner is interested in facing the trial and, therefore, he should be given some opportunity to that effect. 7. I have considered the submissions made by learned counsel for both the sides. 8. Since the petitioner is interested in facing the trial, he deserves to be given adequate opportunity to that effect. 9. Therefore the present bail application is allowed. 10. It is hereby directed that the petitioner Rehan Uddin shall appear before the Page No.# 3/3 Trial Court of learned Special Judge, Sribhumi in respect of Special NDPS Case No.82/2021, within next 10(ten) days from today. 11. On his appearance, the petitioner Rehan Uddin shall be released on bail of Rs.25,000/- with a surety of like amount to the satisfaction of the learned Special Judge, Sribhumi. 12.
