This Interlocutory Application (I.A.) has been filed in Cont.Cas(C) No. 498/2024 seeking impleadment of the following persons as party respondents: 1. Mr. M.K. Yadava, IFS, Special Chief Secretary, Environment & Forest Department, Guwahati, Pin – 781006. 2. Smti. Moushumi Barua, ACS, Secretary to the Government of Assam, Environment & Forest Department, Guwahati, Pin – 781006. 3. Mr. Sandeep Kumar, IFS, Principal Chief Conservator of Forests and Head of Forest Force, Assam, Panjabari, Kamrup (M), Guwahati, Pin – 781037. It is submitted that in the pending contempt petition [Cont.Cas(C) No. 498/2024], there are presently 7 respondents. However, some of these respondents have since superannuated or have been re-designated during the pendency of the petition. The learned Senior Counsel for the contempt petitioner, therefore, prays that the current incumbents, as reflected in paragraph 3 of the I.A., be impleaded as party respondents in place of the Page No.# 3/3 earlier respondents. Upon consideration of the submissions made and upon perusal of the averments in the I.A., this Court is of the view that the impleadment as prayed for is justified at this stage. Accordingly, the I.A. stands allowed. The following persons are ordered to be impleaded as party respondents in place of the existing respondents no. 1 to 7: 1. Mr. M.K. Yadava, IFS 2. Smti. Moushumi Barua, ACS 3. Mr. Sandeep Kumar, IFS The names of the existing respondents no. 1 to 7 stand deleted. The persons mentioned above are to be arrayed as respondents no. 1, 2, and 3 respectively. The petitioner is directed to carry out the necessary amendment in the cause title within 2 (two) weeks from today. The newly impleaded respondents shall be served with fresh notices in the contempt petition and shall be entitled to file their objections or affidavits in accordance with law.
