Order on Board 26.08.2025

“10.1 That Hon'ble Court may kindly be pleased to direct the Respondents to produce the entire records relating to the impugned/transfer order of the Petitioner. 102 That, Hon'ble Court may kindly be pleased to issue writ in the nature of Certiorari/Mandainus and quash the transfer
order dated 09.02.2023 (Annx.P/1) in respect of the Petitioner. 10.3 That. Hon'ble Court may kindly be pleased to stay the operation and effect of the impugned transfer order (Annx.P/1), till the pendency of the instant petition. 10.4 Any other relief, which Hon'ble Court deems fit and proper in the circumstances of the case and petition, may kindly be allowed with cost.”
2. Since no one appears on behalf of the petitioner to contest the case and perusal of the record would show that the petitioner was initially appointed as Revenue Inspector on 27.06.2020 and has been serving with utmost devotion and without any complaint. From time to time he has been transferred within the district and, upon formation of the new district Manendragarh–Chirmiri– Bharatpur, he has been posted in the office of Collector, Land Record of the said district. The record further reveals that by the impugned order dated 09.02.2023, the petitioner has been transferred from District Manendragarh–Chirmiri–Bharatpur to District Sarangarh–Bilaigarh. It also transpires from the record that the State Government has issued a transfer policy dated 12.08.2022 wherein it has been specifically provided that after 30.09.2022 no transfer shall ordinarily be effected, save in rare
3 and exceptional circumstances to be duly recorded with reasons. The impugned order of transfer dated 09.02.2023 has been passed well beyond the cut-off date and no reasoned justification is forthcoming from the order itself. 3. From the record, it shows that vide order dated 23.03.2023, the Co-ordinate Bench of this Court had passed the interim order in favour of the petitioner to the effect that “Considering this aspect of the matter, I.A. No. 01 of 2023 is allowed and the effect and operation of order dated 09.02.2023 (Annexure- P1) shall remain stayed till the next date of hearing.”
4. Considering the matter in its entirety, it is evident that vide order dated 23.03.2023, this Court had already stayed the effect and operation of the impugned transfer order dated 09.02.2023 (Annexure-P/1). By efflux of time, the writ petition has now rendered infructuous, inasmuch as the period of transfer has already lapsed and no surviving cause of action remains for adjudication by this Court. 5. Accordingly, the writ petition stands dismissed as having become infructuous. However, it is made clear that the State shall be at liberty to pass an appropriate order in the matter, if so advised, in accordance with law.
