Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor appearing for the State. 2. The petitioner was arraigned as A.1 in Crime No.94 of 2025 of Bapatla Town Police Station, Bapatla District, registered for the alleged offences under Sections 61(2), 196(1), 353(2) of the Bharatiya Nyaya Sanhita, 2023 and Section 67 of the Information Technology Act, 2000-2008. 3. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the complaint. It is alleged in the complaint that the petitioner posted abusive content on the social media platform, i.e., Facebook, against political leaders. The learned counsel further submits that the offences alleged against the petitioner are punishable by imprisonment of less than 7 years and, therefore, seeks a direction to the police to follow the procedure provided under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023. 4. Considering the submissions of the learned counsel for the petitioner, the Station House Officer, Bapatla Town Police Station, Bapatla District, is directed to follow the procedure as contemplated under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023, 3 CRL.P. No.3320 of 2025 insofar as the petitioner/A.1 is concerned, for the purpose of investigation in connection with Crime No.94 of 2025. 5. Accordingly, the criminal petition is disposed off. 6.
