Learned State counsel submits that charge sheet have been submitted in the matter against the petitioner, after investigation. 5. Since charge sheet has been filed against the petitioner, the petitioner has opportunity to challenge the said charge sheet before appropriate forum, under appropriate provision of law i.e., 482 Cr.P.C. 6. Learned counsel for the petitioner submits that instead of filing a fresh petition, he would amend the same, in light of the judgment rendered by Hon’ble Supreme Court in the case of Mamta Shailesh Chandra Vs. State of Uttarakhand and another in SLP (Crl) No(s).7273/2019). 7. But this Court is of the opinion that instead of amending the present writ petition and to burden the file unnecessarily, it would be wiser for the petitioner to challenge the same in a new petition. 8.
