Order on Board 19.03.2025
1. The present contempt petition has been filed by the petitioner alleging non-compliance of order of this Court dated 22.10.2024 passed by this Court in WPC No. 5278 of 2024 (Annexure C/1). Vide order dated 22.10.2024, this Court has passed the following
order/direction:-
“Be that as it may, after considering the submissions made by the both the
2 parties at bar and on perusal of the documents available on record, this petition is disposed of, at this stage, permitting the petitioner to make a detailed representation before the respondent/competent authority projecting all his grievances as projected in this writ petition along with the copy of petition within 30 days from today and in turn respondent/competent authority expected to consider and decide the same within the period of 120 days from the submission of such representation in accordance with the relevant rules and law applicable to the case of the petitioner.”
2.
Learned counsel for the petitioner contended that the order of this court has not been complied with even after making a representation Annexure C/2.
3. I have heard learned counsel for the petitioner and perused the order passed by this court as well as the representation made by the petitioner placed on record with utmost circumspection.
4. On perusal of the order passed by this court dated 22.10.2024 in WPC No. 5278 of 2024, this court has specifically stated that the petitioner is permitted to make a detailed representation before the respondent/competent authority projecting all the grievances as projected in the said writ petition along with the copy of the petition within 30 days from today and in turn respondent/competent authority expected to consider and decide the same within the period of 120 days from submission of such representation in accordance with the relevant rules and law applicable to the case of the petitioner. However, this court while perusing Annexure C/2 which is the representation made by the petitioner found that the petitioner has not made a detailed representation. The representation lacks detailed grievances as projected in the writ petition with the copy of the petition.
5. Therefore, the present contempt petition is disposed of with the liberty to the petitioner to make a detailed representation before the respondent/competent authority projecting all the grievances as projected in the
3 said writ petition with the copy of the petition within 30 days from today and in turn respondent/competent authority expected to consider and decide the same within the period of 120 days from submission of such representation in accordance with the relevant rules and law applicable to the case of the petitioner.
6. Subsequently, this contempt petition is closed with the aforesaid liberty. sd/- alfiza (Arvind Kumar Verma) Judge
