Also present Ms.Sundari, learned Government Advocate for the State and Mr.S.Vijayanand Sharma, learned counsel for the NCTE and Mr.Kh.Tarunkumar, learned senior counsel assisted by Ms.Maria, learned counsel on behalf of some of the private respondents. The petitioners in these batch of writ petitions are candidates in the recruitment for Hindi Primary Teachers conducted in the year 2023. They challenged the appointment of the private respondents and one of the common issues involved in the writ petitions are for fixing similar cut-off marks for all categories falling under Unreserved and Reserved categories for the recruitment process is over, when the Rule is silent. In the order dated 3.12.2024 as submitted by the parties, it has been recorded that there are four vacancies available for all the categories and four petitioners belonging to General, ST, OBC (M), OBC (MP) may be adjusted against any four available seats and in that case they will not pursue for cancellation of appointment of private respondents. Learned Government Advocate took time for taking instructions as to whether there are vacancies for adjusting the petitioners herein. In pursuance of the observation made in the order dated 3.12.2024, the learned Government Advocate submits a copy of the letter dated 23.1.2025 issued by the Director of Education (S), Government of Manipur to the Commissioner, Education (S), Government of Manipur, with the subject matter to the four pending writ petitions intimating the number of vacancies available. The letter dated 23.1.2025 is taken on record. It is stated that under Unreserved category 14 seats are available, against OBC (M) 8 seats are available, against OBC (MP) 0 (zero) seat is available and against ST 79 seats are available. The petitioners in WP(C) Nos.418 of 2023, 194 of 2023 and 435 of 2024 can be considered for adjustment against the available seats in their categories. In the circumstances, without going into the merit of the case and in terms of the observation made in the order dated 3.12.2024 in the batch of writ petitions, the present writ petitions, i.e. WP(C) Nos.194/2023, 418/2023 and 435/2024 are disposed of by directing the respondents to consider the case of the petitioners for appointment against the available seats. It is made clear that the above direction is with respect to WP(C) Nos.194/2023, 418/2023 and 435/2024. The whole exercise, as directed above, shall be completed within a period of two months from the date of receipt of copy of this order. Misc cases are also disposed of.
