Heard learned counsel for the petitioner and Shri Syed Aftab Ahmad, learned counsel for respondent no.3. 2. Present petition has been filed with the following prayers: "(a) Issue an order or direction thereby directing Learned U.P. Waqf Tribunal at Lucknow (Opposite Party no.1) for expeditious disposal of Case No.123 of 2023 (District-Bareilly) Takmil uddeen alias Danish Versus U.P. Sunni Central Waqf Board and others, pending, since 2023 within a stipulated time period; (b) To issue a writ order or direction in the nature of mandamus thereby commanding the opposite parties no.-3 and their agents from interfering in the peaceful possession of the Land of the petitioner situated at Khata No-89, Gata No-182 measuring 1.4290 Hectare situated at Gram Sirauli, Mu Town Area Pargana Sirauli, Tehsil Awnla, District-Bareilly till the disposal of the case filed before U.P. Waqf Tribunal at Lucknow." 3. It is informed that the Tribunal is not functional in the absence of appointment of judicial member. 4. In view thereof, present petition is disposed off with direction that as and when the appointment is made, the petitioner would be at liberty to move an application for expeditious disposal of the application. 5. In case such an application is filed after re-constitution of the Tribunal, the same shall be heard and disposed off within a period of two weeks.
