Present petition has been filed challenging the order dated 10.03.2025 passed against the petitioner whereby the amounts were directed to be recovered on account of the allegations levelled with respect to construction of toilets. 2. Contention of learned counsel for the petitioner is that a specific reply was filed, however, the same has not been considered. 3. Learned Standing Counsel, based upon instructions, states that the reply could not be placed before the District Magistrate for its consideration. 4. Considering the said submission, the order impugned dated 10.03.2025 cannot be sustained and is quashed. 5. Matter is remanded to the District Magistrate concerned to pass a fresh order after considering the reply submitted by the petitioner in accordance with law. While doing so, an opportunity of hearing shall also be granted to the petitioner. 6. Present petition stands allowed in above terms.
