1. None appears on behalf of the petitioner even when the case is taken up for hearing in the second round. 2. The petitioner has filed this petition seeking the following reliefs:-
“10.1That, this Hon'ble Court may kindly be pleased to call for the records pertaining to the allotment of land of the petitioner. 10.2 That, this Hon'ble Court may kindly be please to set- aside/ quash the undated order passed by the Respondent no. 2 (ANNEXURE P-1) and further be pleased to be please to set-aside/quash the order dated 13.10.2020 passed by the respondent no. 3. 10.3 That, this Hon'ble Court may kindly be please to direct to the respondent authorities to allot the land to the petitioner as prayed by him. 10.4 Any other relief may also be granted by this Hon'ble court in facts and circumstances of the case.”
3. The petitioner has been in occupation of land bearing Survey No.27/1, situated at Patwari Circle No.9, Tehsil Kasdol, District Baloda Bazar, Bhatapara, for the last 40 years. He applied for allotment of a portion of the said land admeasuring 15 x 10 sq. out of a total area of 16.337 hectares. Nagar Panchayat, Kasdol passed a resolution in favour of the petitioner on 4.2.2008. Subsequently, an application was moved pursuant to a circular issued by the State of Chhattisgarh dated 11.9.2019 with regard to rehabilitation. The petitioner has further pleaded that he is regularly paying municipal taxes to respondent No.4.
Based on the application moved by the petitioner for allotment of land, the Collector, Baloda Bazar, Bhatapara called a report from the Sub- Divisional Officer and thereafter, rejected the application moved by the
3 petitioner. The petitioner has challenged the undated order passed by the Collector by filing this petition. 4. Since an order has been passed by the Collector, the same is appealable according to the Chhattisgarh Revenue Book Circular. In view of the availability of an efficacious alternative remedy, in my opinion, this petition is not maintainable and is accordingly dismissed. Sd/-
