The instant application under Section 483 Cr.P.C. read with Section 529 Bharatiya Nagrik Suraksha Sanhita, 2023 (in short 'BNSS') has been preferred by the applicant with the following prayers:- "Wherefore, it is most respectfully prayed that this Hon'ble Court may kindly be pleased to direct the learned Principal Judge, Family Court, Faizabad to decide the case no. 249 of 2024 'Sangeeta vs. Pradeep' under Section 147 BNSS, pending before him, expeditiously within stipulated period, as early as possible." Learned counsel for the applicant has submitted that for execution of the order dated 14.10.2024 passed under Section 125 Cr.P.C., the applicant has moved an application on 28.11.2024 under Section 147 BNSS (erstwhile Section 128 Cr.P.C.), but till date, the matter is has not been decided and is pending from the last four months. On being asked learned counsel for the applicant whether the notice has been served upon the respondent no. 2 or not, he has replied that though the notice has been issued but it has not been served upon the respondent no. 2. At this stage, learned counsel for the applicant has submitted that the applicant may be permitted to withdraw the present application as dismissed as not pressed with liberty to file afresh at the appropriate stage. In view of above, the present application is dismissed as not pressed with liberty, as aforesaid.
