2025:JHHC:15273 IN THE HIGH COURT OF JHARKHAND AT RANCHI A.B.A. No. 2761 of 2025 Jaikant Yadav @ Jaykant Yadav, son of Haradhan Yadav, resident of village Gopladih, P.O Kouribhiyar, P.s. Godda (Town), District- Godda....... Petitioner(s). -Versus- The State of Jharkhand
… Opp. Party(s).
------ CORAM :
SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Manoj Kumar Sah, Advocate. For the State : Ms. Shweta Singh, A.P.P. …..... 04/12.06.2025: This is an application filed by the petitioner praying for grant of anticipatory bail in terms of Sections 482 and 484 of the Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023, as the petitioner have been allegedly implicated in a criminal case registered under Section(s) 126(2), 115(2), 109, 351, 352 and 3(5) of the BNS, 2023 in connection with Godda(T) P.S. Case No. 23 of 2025, pending in the Court of learned CJM, Godda. Heard learned counsel for the parties at length and had gone through the documents, annexed along with this application. Opportunity was given to the State to oppose the bail, which the State availed and opposed. There is direct allegation against this petitioner that he has assaulted the informant and her son and husband. Though the FIR has been registered belatedly yet there are mark of injuries and medical report suggest that they were assaulted. There are fracture in ribs, swelling in the scalp and other injuries, which are grievous in nature. In view of the aforesaid facts, I am not inclined to allow this anticipatory bail application. Accordingly the prayer for bail of the petitioner, named above, is rejected. Anu/-C.P.-3
