For Petitioner : Mr.S.Sukumar For Respondent : Mr.S.Prakash Government Advocate (Crl.side) 1/5 https://www.mhc.tn.gov.in/judis Crl.O.P(MD)No.5650 of 2025 ORDER The petitioners seek anticipatory bail upon the apprehension of arrest at the hands of the respondent police for the alleged offences U/s.403, 405, 408 and 120(B) of IPC in Crime No.6 of 2023 on the file of the respondent police. 2. The case of the prosecution is that the defacto complainant is working as Area Manager of Intel Money Limited, Paramakudi Branch. The petitioner and coaccused were working in that branch. An audit was conducted in that branch on 09.02.2023. The audit report revealed that 1646.9 grams of gold ornaments and cash from the safety locker were taken by the petitioner and coaccused on various occasions and caused loss of nearly Rs.60 lakhs. On enquiry, the petitioner and coaccused themselves agreed their illegal act and repaid a sum of Rs.7.85 lakhs and they undertook to repay the rest of the amount, but they did not repay as agreed. Hence, the defacto complainant lodged a complaint against the petitioner and other accused. 3. The learned counsel for the petitioner has submitted that the petitioner is innocent and he was working as the only customer service officer. The petitioner never caused loss to the company. The petitioner has not committed any offence as 2/5 https://www.mhc.tn.gov.in/judis Crl.O.P(MD)No.5650 of 2025 alleged by the prosecution and he has been falsely implicated as an accused in this case. He is to abide by any condition imposed by the Court and hence, he may be granted anticipatory bail. 4. The learned Government Advocate (Criminal Side) appearing for the respondent police objected the petition. He would submit that the investigation disclosed that the accused had misappropriated the amount repaid by the customers and also had taken jewels pledged by the customers from the loan pockets and kept the pockets empty. Investigation revealed the accused took away 1646.9 grams of gold jewels from the safety locker. The investigation is still pending and the properties are yet to be recovered from the accused. If the petitioner is granted anticipatory bail, the accused would tamper with the evidences and would also not cooperate for investigation and for recovery of property. Hence, he prays dismissal of this petition. 5. Heard and perused the available records. It is seen from the records that the petitioner admits that he was working as a customer service officer in the Intel Money Limited, Paramakudi branch. The Audit was conducted on 09.02.2023 at the said branch, which brought to light that 1646.9 grams of gold ornaments and cash 3/5 https://www.mhc.tn.gov.in/judis Crl.O.P(MD)No.5650 of 2025 from safety lockers were taken away without any record. It is alleged that the petitioner and other accused admitted their illegal act upon conspiracy and also repaid Rs.7.85 lakhs and undertook to repay the rest of the amount. The petitioner has not disputed that he was working in that branch along with coaccused. If so, they are prima facie responsible for maintenance and accounted for the alleged taken away of 1646.9 grams of gold and huge cash. The prosecution said that the investigation is still pending and properties are yet to be recovered from the accused. Considering the alleged overt act against the petitioner and the huge amount and gold jewels of public alleged to be misappropriated, this Court is not inclined to grant anticipatory bail to the petitioner. 6.
