The present petition has been filed with the following relief: "(i) To issue a writ of Mandamus commanding the Opposite Parties No.1 to 4 to take the necessary and prompt action for eviction and removal of the illegal encroachment of the opposite party no.6, 7 and 8 made over the Public Utility Land i.e. Khasra No.271-Ga area 1.6820 recorded as Khalihan in the name of Gaon Sabha situated in village Mahemau, Tehsil Musafirkhana, District Amethi in compliance of the orders dated 23.11.2023 and 22.5.2023 passed by the opposite party no.4 Tehsildar/Assistant Collector, Tehsil Musafirkhana, District Amethi in Case No.693/2023 (Computerized Case No.T202304710200693 (Lekhpal Versus Ram Singh), Case No.694/2023 (Computerized Case No. T202304710200694 (Lekhpal Versus Jag Prasad) and in Case No.695/2023 (Computerized Case No. T202304710200695 (Lekhpal Versus Ramjee) under section 67 of Uttar Pradesh Revenue Code, 2006, as contained in Annexure No.1, 2 and 3 respectively to this writ petition." 3. Learned Standing Counsel, based upon the instructions, states that against an order passed against the encroachers, they moved a recall application, which is pending for consideration. 4. Considering the said submission of learned Standing Counsel, the present petition is disposed of directing the authority to decide the order recall application on its merits and thereafter shall proceed in accordance with law with all expedition.
