Mr. Karan Singh Dugtal, learned counsel for the applicant. 2. Mr. Siddhartha Bisht, learned A.G.A. with Mr. Himanshu Sain, learned Brief Holder for the State. 3. The present applicant ‘Irfan’ S/o Fida Hussain is praying for bail in relation to First Information Report dated 03..02.2024 bearing FIR No. 08 of 2024 P.S. Dharchula, District Pithoragarh, which was lodged against unknown person for missing of two minor victims, who were missing from 01.02.2024. 4. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated and the victims have not supported the case of the prosecution. He submits that the main allegation is against one Irfan S/o Kabir Salmani and not against the present applicant though the applicant’s name is also Irfan but his father’s name is Fida Hussain. He submits that the present applicant is languishing in jail since 06.02.2024 and the charge-sheet has been filed and as such there is no need of custodial interrogation of the present applicant. 5. On the other side, Mr. Siddhartha Bisht, learned A.G.A. argued that after collecting all credible evidences the charge-sheet has been filed and even medical report of both the victims fully supports the case of the prosecution since the hymen of both the victims were found to be torn. 6. After hearing the arguments of learned counsel for the parties and further taking into consideration the age as well as medical report of both the victims, this court is of the view that the applicant does not deserve for bail. 7.
