CORAM :THE CHIEF JUSTICE DHIRAJ SINGH THAKUR SRI JUSTICE R RAGHUNANDAN RAO : 27‘^ March, 2025 DATE PC: The present writ appeal has been preferred against the judgment and
order, dated 13.02.2025 passed in WP.No.6620 of 2024. The writ petition was filed by the petitioner (appellant herein) claiming fishing rights in public tanks measuring Ac.92.20 cents in Sy.No.234 of Chendurthi Village in Kakinada District.
2.
3. The learned single Judge by virtue of the judgment and order impugned while relying upon the Government Order bearing No.776 dated 31.12.1993 as also Government Order bearing No.99, dated 01.05.2019
p w 2 HCJ & RRR,J WA 331 2025 dismissed the petition holding that the fishing rights in public tanks could only be granted in favour of genuine cooperative societies which were registered under the Andhra Pradesh Cooperative Societies Act, 1964 and further since the petitioner society was an unregistered private society, no fishing rights could be granted in its favour.
4.
Learned counsel for the petitioner (appellant herein) does not deny the fact that the petitioner is an unregistered body. Therefore, in our opinion, the petitioner could not have rightly been given any fishing rights over such public tanks.
5. We find no error or perversity in the view expressed by the learned single Judge. The Writ Appeal is found to be without merit and is accordingly dismissed. No order as to costs. Miscellaneous applications pending, if any, shall stand closed.
