After arguing for a while when pointed out that the impugned order dated 07.11.2023 read with order dated 22.10.2024 passed by the Additional Deputy Commissioner (with Powers of Commissioner Agrarian Reforms), Poonch is a well-reasoned order which suffers no illegality, factual as well as legal and more particularly, when the appellate authority has remanded the matter back to the Tehsildar Surankote for a fresh enquiry, the cause of the petitioner, if any, will not be suffering prejudice in any manner whatsoever, the learned counsel for the petitioner seeks withdrawal of this writ petition. 02. Accordingly, the writ petition is dismissed as withdrawn with a direction unto the Tehsildar, Surankote that till fresh enquiry as Serial No. 19 2 WP(C) No. 1552/2025 directed by the appellate authority of Additional Deputy Commissioner (with powers of Commissioner Agrarian Reforms), Poonch is conducted by an adjudication, there shall be no change of khasra girdawari record obtaining as on date with respect to the land forming subject matter of the mutation No. 974 dated 27.01.2021 situated at Village Potha, Tehsil Surankote. 03. This writ petition is, accordingly, dismissed as withdrawn. 04. The matter is remanded to the Collector Agrarian Reforms, (Sub-Divisional Magistrate), Surankote. 05. Parties are directed to appear before the Collector Agrarian Reforms, (Sub-Divisional Magistrate), Surankote on 04.12.2025 who shall thereupon act in compliance to the directions of the Additional Deputy Commissioner (with Powers of Commissioner Agrarian Reforms), Poonch.
