JUSTICE SAMEER JAIN Judgment 13/06/2025 1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-applicant. The accused-applicant was arrested in connection with FIR No. 233/2024 registered at Police Station Nagar District Deeg for the offence(s) under Section 319(2), 318(4), 336(3), 338, 340(2), 317(5), 303(2) & 313 of BNS and Section 66D of Information Technology (Amendment) Act. 2. Learned counsel for the applicant has submitted that the matter is triable by Magistrate. It is further submitted that charge- sheet has been filed. The applicant is a young man aged 20 years. 3. Per contra, learned Public Prosecutor has vehemently opposed the bail application. 4. Considering the arguments advanced by the counsel for the parties and taking note of the fact that the matter is triable by [2025:RJ-JP:23242] (2 of 2) [CRLMB-4210/2025] Magistrate; that the applicant is a young man and there is scope of reformation; that the charge-sheet has already been filed and the trial will take time, looking to the overall facts and circumstances of the case and material on record but without commenting on merits/demerits of the case, this court is inclined to allow the bail application of the accused-applicants and enlarge them on bail. 5. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that accused-applicant Irsad S/o Jom Khan shall be enlarged on bail provided he furnishes a personal bond of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
