Issue a Writ of Certiorari or any other writ, order, or direction of similar nature quashing the Chargesheet by Respondent No.1 produced at Annexure-L in Crime No.0130/2021 filed in CC 626/2022 before II Additional Chief Judicial Magistrate, Bengaluru, Bengaluru Rural for the offences punishable under Sections 427 and 448 read with Section 34 of Indian Penal Code - 3 - NC: 2025:KHC:7872 WP No. 1192 of 2024 c. Issue a Writ of Certiorari or any other writ, order, or direction of similar nature quashing order dated 10.2.2022 in CC No.626/2022 passed by Learned II Additional Chief Judicial Magistrate, Bengaluru, Bengaluru Rural produced at Annexure-K; d. Grant such other reliefs as the facts and circumstances of the case may warrant, in the interest of justice and equity." 2. A perusal of the material on record will indicate that respondent No.2-defacto complainant is none other than the son of petitioner No.1 and petitioner Nos.2 and 3 are the maternal grand parents of respondent No.2. Respondent No.2 filed the instant compliant, which is registered as an FIR in Cr.No.130/2021 for the offence punishable under Sections 427 and 448 r/w Section 34 of IPC. According to respondent No.2- complainant, petitioners are alleged to have committed trespass into the residential premise as can be seen from the impugned complaint as Annexure-H dated 22.05.2021. Further, in addition to the aforesaid compliant, civil proceedings in O.S.No.1373/2022 are pending between the petitioners and respondentNo.2; so also arbitration proceedings between - 4 - NC: 2025:KHC:7872 WP No. 1192 of 2024 petitioner No.1 and respondent No.2 are also pending before the Arbitral Tribunal. It is, therefore, clear that the dispute between the petitioners and respondentNo.2 is essentially, predominantly and overwhelmingly of a civil nature/character, which is sought to be given a criminal colour/flavour by respondent No.2 which is impermissible in law as held by the Apex Court in the following cases: (i) Naresh Kumar and Another. v. The State of Karnataka and another, reported in (2024) INSC 196. (ii) Lohit Chaturvedi and Others. v. State of Uttar Pradesh and Another., reported in 2024 SCC OnLine SC 171 . 3. Further, a perusal of the impugned complaint, FIR, statement of witnesses, documents, charge sheet etc., cumulatively establish that the offences alleged against - 6 - NC: 2025:KHC:7872 WP No. 1192 of 2024 petitioners are not been made out by respondent No.2- complainant and consequently, continuation of the impugned proceedings as against the petitioners would amount to abuse of process of law warranting interference in the present petition. 5. In the result, the following: ORDER i) The criminal petition is allowed. ii) The entire proceedings in C.C.No.626/2022 pending before II Additional Chief Judicial Magistrate, Bengaluru, arising out of FIR in Crime No.130/2021 registered by respondent- Police, qua the petitioners, are hereby quashed.
