The petitioner has been made accused in connection with Ramgarh P.S. Case No. 223 of 2024, corresponding to G.R. Case No.609 of 2024, S.T. Case No.140 of 2024, for the offences registered under Sections 103(1), 191(2) and 61(2) of the Bharatiya Nyaya Sanhita, 2023, pending in the court of Ms. Kusum Kumari, learned Sessions Judge, Ramgarh. Bail application of the petitioner was earlier rejected by this Court vide B.A. No.9786 of 2024, by order dated 13.01.2025, with the direction to the learned Trial Court to expedite the trial. Petitioner happens to be the husband of the deceased Nipu Kumari, who died in her matrimonial home due to asphyxia because of hanging. It is alleged that the accused persons were torturing her to enforce the demand of Rs. 25.00 lakh as dowry. Learned senior counsel for the petitioner has submitted that the marriage of the deceased with the petitioner took place nine years ago. It was further submitted that after investigation, chargesheet was submitted under Section 306 of the Indian Penal Code and the charge has also been framed under same section. It was also submitted that the deceased had -2- committed suicide due to the family dispute. Report regarding the stage of the trial has been received. It appears that out of 15 witnesses, only one witness has been examined. It further appears that petitioner is in custody since 08.08.2024. In view of the submission made above, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of Ms. Kusum Kumari, learned Sessions Judge, Ramgarh, in connection with Ramgarh P.S. Case No. 223 of 2024, corresponding to G.R. Case No.609 of 2024, S.T. Case No.140 of 2024. (Ambuj Nath, J.) BS/-
