Neutral Citation No. - 2025:AHC-LKO:16878-DB Court No. - 2 Case :- WRIT - C No. - 2841 of 2025 Petitioner :- Mohd.Sufiyan Respondent :- State Of U.P. Prin. Secy. Home Lko. And 6 Others Counsel for Petitioner :- Abdul Samad,Sunil Sharma Counsel for Respondent :- C.S.C. Hon'ble Rajan Roy,J. Hon'ble Om Prakash Shukla,J. Heard learned counsel for the petitioner as also Sri Umesh Singh, learned counsel appearing on behalf of opp. party No. 6 and the learned Addl. C.S.C. for the State. Grievance of the petitioner is that opp. party No. 6 and 7 are not considering the issuance of No-Objection-Certificate on account of which his application for grant of food license remains pending before the opp. party No. 5. Let the opp. party Nos. 6 and 7 take a decision in the matter and communicate it to the opp. party No. 5 positively within 3 weeks, however, at this stage Miss Akansha Dubey, learned Addl. C.S.C. informs the Court that the application of the petitioner for grant of food license has been auto rejected (online) on account of non-submission of relevant documents and formalities. Be that as it may, it appears that the N.O.C. etc. were required to be uploaded alongwith the application, which was not done and it is only after the defect was pointed out online, the representations were submitted to opp. party Nos. 6 and 7. We, therefore, grant liberty to the petitioner to first of all seek N.O.C. from the opp. party Nos. 6 and 7 and then upload the requisite documents while applying afresh for the food licence. If such representations are submitted before the opp. party No. 6 and 7 and there is no legal impediment, then they shall consider issuance of the same and dispose it of within 3 weeks of its receipt, so that the petitioner may apply for issuance of food license. With the above observations/directions this writ petition is
disposed of. (Om Prakash Shukla, J.) (Rajan Roy, J.)
