The present application under Section 482 Cr.P.C./528 B.N.SS has been filed for the following main relief:- "Wherefore, it is most respectfully prayed that this Hon'ble High Court may kindly be pleased to quash the entire proceeding of Session Case No.36/2025, State Vs Anil Jaiswal, arising out of Case Crime no. 134/2024, under section- U/S- 70(2), 137(2), 351(3) BNS and Section-5/6 POCSO Act and section-3(2) (v) SC/ST Act, Police Station-Saidulla Nagar, District-Balrampur, is pending before the learned Special Judge, (POCSO) Act, Balrampur (U.P.) and also quash the impugned charge sheet dated 14.01.2025, filed against the petitioner as well as the impugned cognizance & summoning order dated 12.02.2025, passed by the Special Judge (POCSO) Act, Balrampur (U.P.), contained as Annexure No.1 and 2 to this application/petition, in the interest of justice." Learned counsel for the applicants, after arguing at some length, has submitted that the applicant may be permitted to withdraw the present application as not pressed with liberty to applicant to move discharge application before the court concerned and the same may be directed to be decided expeditiously. As such, the present application is dismissed as withdrawn with liberty to the applicants to move an application of discharge. In case, any such application is preferred by the applicants, the same may be decided expeditiously in accordance with law, if there is no other legal impediment.
