This is the second round of litigation before this Court. 3. This writ petition relates to the property situated at S.F.Nos. 98/110A, 98/7, 98/8B and 98/9 of Kothapuli Village, Dindigul West Taluk, Dindigul District. The petitioner secured the said property by way of two documents, namely, a settlement deed, dated 24.10.2013, executed by her father, P.Perumal Bogan and by way of partition cum release deed, dated 30.10.2014 executed by one Kaliyappan and eight others. 4. The petitioner alienated the property in favour of one Minor.Saravana, S/o.Kaliyappan. At the time of registration, an 2/8 https://www.mhc.tn.gov.in/judis W.P.(MD)No.8394 of 2025 undertaking was given by the petitioner to clear any encumbrance that may be found in and over the property. The encumbrance certificate reflected that the proceedings had been initiated by the District Collector of Dindigul District in Na.Ka.No.82/2017/19B4, dated 18.07.2014. In order to find out as to what are the proceedings, which is referred to in the encumbrance certificate, the petitioner applied to the District Collector under the Right to Information Act. He was informed by the District Collector office that there is no such proceedings pending on the file of the District Collector. The petitioner moved this Court by way of a writ petition in W.P(MD).No. 25902 of 2024. In the said writ petition, a direction was given to the Tahsildar to conduct an enquiry and submit a report to the Sub- Registrar at the earliest. Further, a direction was given to the Sub- Registrar to act in accordance with the report filed by the Tahsildar. Despite this direction, as there has been no further progress, the petitioner has approached this Court by way of the present writ petition. 5. In this regard, the petitioner already submitted a representation before the first respondent. In turn, the first respondent directed the third respondent to conduct enquiry and submit a report. 4. In view of the above, the third respondent is directed to conduct enquiry and submit a report before the second respondent as early as possible. Accordingly, the second respondent is directed to act upon on the basis of the report submitted by the third respondent scrupulously. 5. With the above direction, this Writ Petition is disposed of. This makes it clear that there is no proceeding, as found in the encumbrance certificate, on the file of the District Collector, Dindigul. 7. The Registration Act and the Rules made thereunder do not empower the authority created under the Act to remove the encumbrance certificate, if it has been entered on the basis of valid proceedings or document. In the present case, the encumbrance certificate has been kept into the file of the second respondent on the basis of the non-existing proceedings of the District Collector. In view of the same, this Writ Petition is disposed of with a direction to the second respondent to delete the said entry from his file and report to this Court. No costs. 8.
