Heard Mr. Purnchand, learned counsel for the petitioners. Also heard Mr. Hariom Rai, learned Panel Lawyer for respondent No.1 to 3 / State. 2. The petitioners have filed this petition praying for following relief:- “ 1. That, Hon'ble Court may kindly be pleased to allow the instant petition under section 528 of B.N.S.S. 2023 filed by the petitioner, in the interest of justice. 2. That, Hon'ble Court may kindly be pleased to quash the FIR bearing No. 119/2024 registered on dated 09.03.2024 at police station Kusmunda, District Korba Chhattisgarh filed under section 498- A, 34 of the I.P.C. in the interest of justice. 3. That, Hon'ble Court may kindly be pleased to quash entire charge sheet dated 26.09.2024 before learned Judicial Magistrate First Class Katghora District Korba Chhattisgarh under section 498-A, 34 of the I.P.C. in the interest of justice. 4. That, Hon'ble Court may kindly be pleased to quash the impugned criminal proceeding as Criminal Case No. 2724/2024 before the learned Judicial Magistrate First Class Katghora District Korba Chhattisgarh in respect of case of the petitioners, in the interest of justice. 5. That, the Hon'ble Court may kindly grant any other reliefs in favour of the petitioners, which the Hon'ble Court deemed fit & just in the facts and circumstances of the case, in the interest of justice” 3. Learned counsel for the petitioner prays to withdraw the present petition stating that present matter pertains to a matrimonial 3 dispute between the respondent No. 4 and brother of petitioner No.2, who has not been made a party in the present petition. 4. In view of the same, as prayed by learned counsel for the petitioner, this petition is dismissed as withdrawn, with liberty to file afresh impleading brother of petitioner No. 2 as a party, so that the matter may be referred to Mediation Centre. 5. Learned Panel Lawyer appearing for respondent No.1 to 3 / State is present. 6. Certified copy of the documents annexed in the petition, if any, may be returned back to the counsel for the petitioner after obtaining the photocopy of the same.
