Sri Atul Dwivedi, learned counsel for the respondent no. 3. Sri Brijendra Singh, learned counsel holding brief of Sri Ravi Singh, learned counsel for the respondent no. 2. It has been informed by Sri Dwivedi, learned counsel that earlier the affiliation granted by the respondent no. 3-University was cancelled which was assailed by the petitioner in Writ-C No. 18775 of 2025 which was allowed by the Court on 27.02.2025, however, liberty was granted to the University to proceed with the provisions and regulations. It has further been informed by Sri Dwivedi that on 09th April, 2025, a show cause notice has been issued to the petitioner- institution indicating the deficiencies and the same is required to be responded within a period of three days as per the notice and a copy of the same has been produced before the Court. At this stage, the learned counsel for the petitioner submits that since the copy has been received only on 09th April, 2025 itself. At this stage, the learned counsel for the petitioner submits that since he would be responding to the show cause notice and depending on the result which would given a fresh cause of action, the petitioner may be permitted to withdraw the petition at this stage with liberty to assail the order, if found against the petitioner. Accordingly, the present petition is dismissed as not pressed. Needless to say that in case if the petitioner responds to the aforesaid show cause notice within the time as mentioned in the notice dated 09.04.2025. The respondent-University shall ensure that the same is taken with expedition and be decided within a period of two weeks from and inform the same to the petitioner.
