Civil Writ Petition No.13319/2015, which came to be dismissed for non-prosecution vide order dated 12.10.2023. 2. Counsel for the petitioner submits that on account of his bona fide mistake he could not appear on 12.10.2023 and the petition was called on board. Due to oversight he could not mark the case and could not put in appearance. 3. Considering the reasons assigned in the application and the fact that the restoration application has been filed soon after having knowledge of rejection of petition as also considering the issue involved in the writ petition, this Court deems it just and proper to allow the instant application.
