IN THE HIGH COURT OF ORISSA AT CUTTACK CRLMP No.167 of 2025 Janaki Behera … Petitioner Mr. S.K. Mohanty, Advocate -versus- State of Odisha & Others … Opposite Parties Mr. M.K. Mohanty, Addl. PP CORAM: JUSTICE G. SATAPATHY Order No. ORDER(ORAL) 12.02.2025 01. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode). 2. The sole grievance of the petitioner in this case is for non-incorporation of Section 109 of BNS. 3. Heard learned counsel for the parties and perused the record. It appears from the record that on the written complaint of the petitioner, an FIR has been registered for certain offences, but the petitioner is aggrieved for non-incorporation of the provision of Section 109 of BNS. If that be so, the petitioner is at liberty to file a protest petition after conclusion of the investigation, but at this stage, this Court does not feel it proper to interfere in this matter. 4. In the result, the present CRLMP stands dismissed. (G. Satapathy) Judge S. Sasmal Designation: Jr. Stenographer
